I spoke to my lawyer but i dont agree…what would you do?
Ok break in down in point form maybe i will get more answers.-ex and i split 8months ago, agreement drawn in summer for (basic) overnight access at my exs house every other weekend. and a move restriction to 100km for either of us with 60 day notice if no notice agreement will reopen-Ex moved in with mom in late aug. His mother (my sons grandma) is rapid cycling bipolar, suicidal, and an extreme alcoholic. Dangerous envirnmnet for my son to be in.-lawyer and i terminated overnight access and took the agreement off judges is desk before final signature.-Ex has not excercised access in the last 3.5 months. A handful of times he has seen desk Lawyer our son for a few hours (our son does not know him and wont go near him when he is around)-Recently ex obtained a lawyer (for $500/hr yet has not paid child support in 2 months) and the lawyer wrote a formal letter in which we are at this moment unclear of what he wants.1st question-In the formal letter she stated that my ex can not excercise access at this time as the distance is too great to entertain a one year old for a few hours (he has to drive 2 hours to see him) Why would a lawyer advice her client to terminate access due to distance? Doesnt that look badly on him if matter was taken to court?Question #2: In the letter it also stated that my ex father in law (sons grandfather) will be intouch to arrange a chirstmas access day. He has not seen our son in over 7 months. My ex hasnt seen our son in 1.5 months. My son does not know these people and I am certain they would bring my son to his mothers behind my back.My lawyer told me to allow acces as she does not want to get slapped with an emergency access order from his lawyer. I dont agree with her. I would allow an access in my home or supervised but i do not feel comfortable allowing my son to go with them for the day. Not only that but his dad wrote me an email a few months back stating he was leaving this week for africa so how can he even be here for the christams access??What should i do when the time comes??
