Need Legal Advice about Ownership of Furniture! Im getting SUED!?
One year and two months ago I had a roommate move out of my apartment. When she moved she decided to sell me three couches, two table, and a TV for $500.00. I gladly and willingly paid. However right before she moved she said her mom wont allow her to sell the TV, but instead she will sell us the secretary (its an old fashioned desk). So we corresponded over FB messaging since we rarely saw each other. SO I have these messages secretary desk furniture still, the ones saying she will sell us these items. I even have messages of her emailing my other roommate saying she has received my share of the money, $250.00. Anyway, her and her mom have contacted me now quite rudely I must say demanding we sell back the secretary, as it was never our property. The offered 20$ and we said we would like what we paid for it, or half at least. They said we have no option that we will take the 20$ and that’s final. So I said when they can be civil we will talk. Now her mom is trying to sue me! Does she have a case? She said it belongs to her deceased husband and was part of his estate, and now that she is executor of said state I have no claim to it. But he died months after they sold it to us, and in her messages she acknowledges her daughter selling it to us, but with out her permission. So I need to know, that with my documents (FB messages) can she take me to small claims court, and win? Thanks! Any advice is much appreciated!
